ANALISIS YURIDIS SANKSI PIDANA DALAM KETENAGAKERJAAN DITINJAU DARI ASPEK KEADILAN (ANALISIS PUTUSAN NOMOR 714/PID.SUS/2022/PN.SBY)

Juridical Analysis of Criminal Sanctions in Employment viewed from the Justice Aspect (Analysis of Decision Number 714/Pid.sus/2022/PNSBY is a matter that the author examines regarding this inaccuracy whether it is in accordance with Law number 11 of 2020 concerning Job Creation. This writing reviews according to the Theory of Legal Justice and the Job Creation Law using the Normative Juridical approach method with a technique, namely collecting legal material, namely by studying literature, namely by examining legal material. The conclusions and suggestions from this writing are that there is an inaccuracy in the imposition of criminal sanctions in employment in terms of the aspect of justice and according to the analysis of the decision, the facts in the decision regarding injustice that are not in accordance with the theory of justice and in the wording of the article contained in the copyright law work, what is meant is imprecision regarding the imposition of criminal sanctions and punishments that tend to be one-sided. The law should be made to serve as a support and to make things easier, then the government needs to review the work copyright law to make it clear that there is compensation, not just the imposition of criminal sanctions.
