Abstract

As explained in Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers, it is stipulated that the central and regional governments have an obligation to protect all PMI from before work, during work, to after work. This research aims to determine the government's efforts to protect the rights of migrant
workers and analyze sanctions for companies placing migrant workers who do not comply with agreements resulting in default. The method used in this research uses a normative juridical approach, which views law as a norm in society. Usually
formal workers receive stronger legal protection than migrant workers. Meanwhile, informal workers who have low skills (unskilled) with a minimum level of education will be placed in work sectors that have a high risk. Cases that often befall Indonesian migrant workers are cases of non-compliance with employment
agreements, including abuse, sexual harassment, refusal to pay wages by employers, and unilateral termination of employment. In conclusion, although the government provides protection to PMI, more efforts are needed to guarantee their rights and uphold human dignity. Legal certainty and consistent application of laws
and regulations are very important for the protection of PMI. Recommendations ensure that existing regulations, as well as derivative regulations, are continuously evaluated.
