Abstract

Traffic accidents are increasing every year. Apart from the increasing mobility or number of community activities, the number of motorized vehicles is increasing. This is what causes the number of fatalities due to accidents on land, sea and air to also increase. The Turangga train (KA) connecting Surabaya-Bandung collided with the Bandung Raya Local Train on Jalan Cicalengka, Kabupaten Bandung, West Java, Friday (5/1/2024). The purpose of this research is to find out PT. KAI is responsible for passengers who experience accidents between trains and the efforts provided by PT. KAI for passengers who experience accidents between trains. The method used is Empirical Juridical with the type of study at PT. KAI Bandung by collecting interview data with Kantor Pusat PT. KAI Bandung and PT. Jasa Raharja (West Java) and laws, research results using papers and literature, data collection techniques obtained separately and then grouped to find out the problems and analysis of data collected and obtained primary, secondary and tertiary, analyzed towards conclusions from the data obtained. The result of the writing is that the accident between the Turangga train and the Greater Bandung Commuter Line was a signaling anomaly which resulted in biased PPKA (Train Travel Regulator) decision making to depart the train at each station, with this incident PT. KAI collaborates with PT. Jasaraharja provides accident coverage for train passengers. That when transporting passengers by a public railway company, the carrier is responsible for the passengers based on a carriage agreement, namely a reciprocal carriage agreement between the carrier and the passenger in which the carrier commits itself to carrying out the transportation of goods or people from one place to the destination.
