Abstract

The case of fictitious orders and legal protection for online ojek drivers is not specifically regulated in Law Number 8 Year 1999 and it causes legal vagueness. To provide legal protection to online ojek drivers can seek preventive and refressive legal protection. The formulation of the problem in this study is how to analyze the application of Legal Protection for Online Ojek drivers against Fictitious Orders in the Shopee Food Application. The approach used is normative law with a focus on legislation and conceptual legal protection. The research method involves literature study to analyze the relevance of legal documents. The results showed that the Consumer Protection Law that online ojek drivers are not specifically protected from fictitious orders under Consumer Protection Law Number 8 Year 1999. Consumers now have greater legal protection, including the right to comfort, security, and safety as well as the ability to choose products and services and accurate information about those products and services. To provide justice and compensation to online ojek drivers affected by fake orders, repressive legal protection is needed. The current legislation prioritizes consumer protection rather than providing a quick and efficient way for drivers to resolve disputes.
