PERTANGGUNGJAWABAN PERDATA TERHADAP KORBAN KECELAKAAN YANG TERJADI AKIBAT KELALAIAN PIHAK BANDAR UDARA

The incident that caused a woman to die under an elevator due to negligence in airport operations has become a big public question as to how the services provided were not in accordance with established standards, resulting in victims. Upon closer examination, the process of civil accountability to victims is considered lacking so that it is not clear regarding the fulfillment of victims' rights. The purpose of this writing is to find out how civil liability is and the fulfillment of aspects of legal certainty and justice for deaths caused by airport negligence in accordance with the Aviation Law. The research method used in this final assignment is normative juridical research by collecting legal materials consisting of primary materials in the form of legislation and secondary materials in the form of supporting literature such as books and journals. The results of the research show that the provisions regarding civil liability in the Aviation Law are regulated in article 240 by adhering to the principle of liability based on fault. Meanwhile, regarding certainty and justice, it is considered sufficient, but it is necessary to increase the nominal amount and other details as a form of fulfilling justice to the community.
