Tinjauan Yuridis Terhadap Prinsip Kerahasiaan Dalam Penyelesaian Sengketa Perdata Melalui Arbitrase Online

Today's technological developments have had a significant impact on arbitration practice, directing it from conventional methods to a more modern form, namely online arbitration. The principle of confidentiality in business arbitration is an important factor that makes dispute actors choose arbitration forums to resolve their disputes confidentially. This research aims to find out how the principle of confidentiality is guaranteed in resolving civil disputes through Online Arbitration. The type of research used is normative juridical with material collection techniques through literature study. There is a problem regarding the guarantee of confidentiality in resolving civil disputes through online arbitration, namely that there is a discrepancy in the formal procedures carried out in resolving disputes through online arbitration, which causes the principle of confidentiality in online arbitration to be questioned. So there is a need for strong norms to guarantee confidentiality by updating Law Number 30 of 1999 concerning Arbitration and Alternative Joint Dispute Resolution with procedural rules by BANI as well as increasing existing supervision by related institutions.
