PENERAPAN HUKUM PADA CIPTAAN LAGU YANG MUSIKNYA DIGUNAKAN OLEH PERUSAHAAN RADIO (STUDI KASUS DI RRI KOTA MALANG)

Copyright song is the exclusive right of the creator that arises automatically based on the declarative principle after a song can be heard. Therefore, copyright provides a guarantee that the creators not only keep the results of his work under supervision and provide assurance that the creators can obtain the benefits of the results of his intellectual work. Therefore, this study aims to determine and examine the Application of Law on the Creation of Songs whose Music is Used by Radio Companies (Case Study at RRI Malang City). The research method used in this research is the sociological juridical method. By using the type of primary data, namely data obtained directly by researchers through in-depth interviews with the music director of RRI Pro 1 Malang and secondary data consisting of laws, documents related to royalty payments and management to deepen understanding of the Application of Law on Song Creation whose music is Used by Radio Companies then analysed descriptively qualitative. The results of this study provide insight into the application of the law on the creation of songs used for commercial purposes on radio RRI Pro 1 Malang. As well as the mechanism of payment of royalties on copyrighted musical works and songs on radio RRI Pro 1 Malang. In addition, this research also provides recommendations to improve the application of the law on the creation of songs used for commercial purposes on the radio. This research is expected to contribute to the development of policy and practice of the application of the law on the creation of songs used for commercial purposes on the radio in providing assurance that the creators not only keep their work under surveillance.
