Abstract

Banyuwangi is one of the regions that has implemented an electronic land certificate program. With a sense of curiosity, the author wishes to examine the effectiveness and objectives of the implementation of electronic land certificates in Banyuwangi District. The research method used by the author is the normative-empirical method in which data sources are divided into a dichotomy: primary and secondary. Primary data were obtained from in-depth interviews with the Head of the Rights Determination and Land Registration Section at the Banyuwangi District Land Office, while secondary data were qualitatively categorized using the library research method. The authors then analyzed the data using the Miles and Huberman method. This study found that the implementation of electronic land certificates in Banyuwangi through the agrarian reform program: Land Redistribution is in accordance with the theory of legal objectives because it fulfills 3 (three) aspects: Legal Certainty, Benefit, and Justice. Meanwhile, according to the theory of legal effectiveness, the implementation was not achieved effectively because one of its elements was not fulfilled. That element is “The law should prohibit, not require”. Whereas in the regulation of electronic land certificates there are no such words, the program is carried out in stages. The conclusion of this study is that electronic land certificates in Banyuwangi district have fulfilled the elements of legal objectives but cannot yet be declared effective.
