ANALISIS YURIDIS SOSIOLOGIS PENYELESAIAN KONFLIK ATAS KEPEMILIKAN SERTIFIKAT GANDA(Studi Di Kecamatan Batu Kajang Kota Kabupaten Paser Samarinda Kalimantan Timur)

In this research, the author wants to analyze juridically the process of land acquisition or land rights owned by the people of Batu Kajang Village who have the same certificates as those belonging to PT Kideco Jaya Agung, then analyze the factors that cause falsification of documents, as well as efforts to resolve conflict issues. that exists between the mining company and the people of Batu Kajang Village. The research method used by the researcher is sociological juridical with data collection techniques through interviews. The research results show that the conflict resolution process through mediation shows an effort to achieve a win-win solution, but still requires legal firmness. Legal protection of land ownership can be achieved through a judicial process that decides the legal force of a valid certificate. The resolution of this conflict also underscores the importance of the government's role in facilitating mediation and enforcing the law. While the Basic Agrarian Law provides a legal basis, there are challenges in its implementation, especially regarding deliberate violations of the law. Clear legal protection for land certificate holders is needed, with the important role of judges in ensuring the truth of the information in the certificate. Apart from that, legal protection can be seen from the provisions of Government Regulation Number 24 of 1997 concerning Land Registration, which provides guarantees for certificate holders for land that was obtained in good faith and is actually controlled.
