Abstract

The advancement of technology and information, especially with the presence of the internet, is the main trigger for the emergence of digital-based financial technology. The internet has become a basic need for people in all aspects of life in this digital era. The growth of e-commerce is bound to have both positive and negative impacts on Indonesia's trade structure. From the data collection has been seen and pronounced from the Ministry of Communication and Information, there were at least 110,000 reports related to the alleged involvement of accounts in online fraud crimes until August 25, 2020. Fraud with the mode of buying and selling online in practice is also rampant in the payment method using Paypal. The Paypal payment method is designed to facilitate transactions in the context of e-commerce, auctions, and other business activities. Fraud cases involving the use of PayPal payment balance top-up services have shown that fraudulent crimes over the internet can be easily committed in the online buying and selling system. Before the ITE Law came into force, investigations into crimes in e-commerce faced significant obstacles due to the absence of adequate provisions in Article 378 of the Criminal Code to regulate this type of crime. The existence of the ITE Law as a legal umbrella for the existence of e-commerce practices in Indonesia has not been able to fully accommodate efforts to prevent crimes in electronic transactions in addition to the lack of efforts to protect victims of crime in online buying and selling transactions.
