PERLINDUNGAN HUKUM TERHADAP KONSUMEN DALAM PENJUALAN ROKOK ILEGAL (Studi Kasus di Kantor Bea dan Cukai Malang)

Regarding the form of consumer protection in purchasing goods, consumers have the right to obtain security in consuming goods, and have the right to obtain correct, clear and honest information regarding the condition of the goods. Illegal cigarettes are cigarettes whose production and distribution do not comply with statutory regulations both in terms of the materials and types used in making the cigarettes. Another criterion is the absence of fake excise or excise stamps. As for this research, the author formulated the main problem as follows, 1) what are the solutions to prevent the distribution of illegal cigarettes by the customs and excise office in Malang City. 2) How is the form of consumer protection against illegal cigarettes reviewed according to Law No. 39 of 2007 concerning excise carrie out by the customs and excise supervision and service office in Malang City.This research uses empirical research using a sociological juridical approach. The data sources used are primary and secondary data with data collection methods through interviews, observation and document study. Meanwhile, the data processing methods used are editing, clarification, verification, analysis, and conclusion. The results of this research are:
First, how to resolve efforts to prevent the distribution of illegal cigarettes by the
customs and excise office in Malang City, which has made preventive efforts, namely outreach to the community, both in markets and in small shops, to traders. And the repressive efforts carried out are mobile patrols with related law enforcement officers. Second: How is the form of consumer protection against illegal cigarettes reviewed according to Law No. 39 of 2007 concerning excise carried out by the customs and excise supervision and service office in Malang City with socialization activities and giving excise stamps to legal cigarettes is a form of protection and certainty laws to consumers and ensure consumers get cigarettes that comply with existing regulations.
