EFEKTIVITAS PELAKSANAAN PASAL 76 UNDANG-UNDANG NOMOR 13 TAHUN 2003 TENTANG KETENAGAKERJAAN BAGI PEKERJA PEREMPUAN YANG BEKERJA SHIFT MALAM DI COFFEE SHOP KOTA MALANG (Studi Kasus di Birko Cafe and Space dan Trijata Koffie)

Women workers who work at night are specifically regulated in Article 76 of Law Number 13 Year 2003 on Manpower. The law is the legal basis for the protection of women workers, because basically the protection of workers is intended to guarantee their basic rights and ensure equal opportunities and treatment without discrimination on any basis to realize the welfare of workers. This research focuses on the implementation and effectiveness of the implementation of Article 76 of Law Number 13 of 2003 concerning Manpower for female workers who work on night shifts in coffee shops in Malang City and focuses on factors that support and hinder the implementation of Article 76 of Law Number 13 of 2003 concerning Manpower. The research method used in this research is empirical juridical method by conducting interviews and asking for information from female workers through questionnaires. The result of this study is that Article 76 of Law Number 13 of 2003 concerning Manpower is still not effective and well implemented because there are still violations committed by coffee shop managers as employers. In addition, law enforcement on violations in matters relating to labor in Malang City is still not implemented optimally, so that many violations occur without any sanctions.
