PEMENUHAN HAK PEKERJA MIGRAN INDONESIA PADA SAAT PEMULANGAN KE DAERAH ASAL DIWILAYAH BP2MI MALANG

Explained in law number 18 of 2017 concerning the protection of Indonesian migrant workers, article 6 letter L, which is to obtain guarantees to protect the safety and security of the return of Indonesian migrant workers to their home areas, in this article it is explained that Indonesian migrant workers have the right to obtain guarantees and protection of return to their hometowns, but in its application, BP2MI Malang still often has difficulties in optimizing the protection of guarantee rights and security for PMI's return in the working area of BP2MI Malang. This research aims to find out what are the causes or reasons that make BP2MI Malang still not optimal in giving its rights to PMI, especially in the guarantee and security of the return of migrant workers to the area of origin. This research is included in empirical juridical research, and to obtain the data needed by researchers directly conducting spacious research using a data collection method in the form of interviews with BP2MI Malang staff, and the coordinator of the UPT BP2MI Malang office. So that in this research, fundamental reasons can be found related to the obstruction of the fulfillment of PMI rights by BP2MI Malang
