Abstract

This research aims to find out about the regulations regarding the removal of the TikTok Shop platform by the government and to find out about the government's policy regarding the removal of the TikTok Shop platform from the perspective of justice theory. The method used in this research is a type of Normative Legal Research with a statutory approach, this research also uses a case approach which is used in the context of problem solving. The research results obtained were that the TikTok Shop platform was removed due to many complaints from local SMEs to the government regarding the existence of the TikTok Shop platform so that many SMEs experienced a decline in turnover in the last few years. In response to this problem, the government stipulated Regulation of the Minister of Trade of the Republic of Indonesia Number 31 of 2023 concerning Business Licensing, Advertising, Guidance and Supervision of Business Actors in Trading Through Electronic Systems, where this regulation does not fulfill all the substantial points of John Rawls' theory of justice
