Abstract
This research discusses non-litigation efforts in resolving the problem of paying interest on credit agreements for debtors who die by applying alternative dispute resolution outside the court. This research provides an overview of the importance of considering various non-litigation legal remedies in resolving problems. The main focus of this settlement is to identify and analyze the non- litigation settlement methods applied in this study. Through a sociological juridical legal approach and descriptive qualitative case analysis, this research explains the non-litigation settlement strategy in the form of negotiations used to resolve existing problems without involving formal court processes. This descriptive qualitative analysis emphasizes the importance of effective and sustainable problem solving, taking into account the legal and justice aspects involved in the context of credit agreement interest payments to deceased debtors. Emphasis is placed on the advantages of implementing non-litigation remedies in minimizing costs and time, creating good relations between the parties involved, as well as providing flexibility in reaching a fair and beneficial agreement for the parties through negotiations. Accompanied by good faith and the existence of certain things that are in the interests of the parties so that they become supporting factors arising from the parties in the process of resolving related problems. The results of this study are expected to be a basis for various practitioners, both in the fields of law, finance, and the wider community in dealing with similar problems.
