Perlindungan Hukum Bagi Para Pihak Dalam Kegiatan Waralaba (Franchise) Ditinjau Dari Aspek Asas Keseimbangan (Studi Pada Waralaba Bandardimsum Tulungagung)

This research aims to determine the application of the principle of balance in the contents of the Bandardimsum Tulungagung franchise agreement as well as the application of legal protection for the parties in the Bandardimsum Tulungagung franchise agreement in terms of the principle of balance. The research method used is an empirical research method with a sociological legal approach, namely an approach to a problem by paying attention to applicable legal norms and connecting it with the facts of the problem raised by the author. The results of this research are that the application of the balance principle in the Bandardimsum Tulungagung franchise agreement does not fully fulfill the balance principle. Because there is a party that dominates the making of the agreement, namely the franchisor without involving the franchisee. The application of legal protection for the parties in this agreement is divided into 2, namely preventive legal protection and repressive legal protection. Preventive legal protection in this agreement is marked by the signing of the agreement by the parties. Meanwhile, repressive legal protection in this agreement is regulated in the article regarding termination or cancellation of the agreement. To fulfill the principle of balance, an article should be added that regulates sanctions if the franchisor commits a violation, because it does not rule out the possibility that the franchisor may also commit a violation.
