Abstract
A building construction permit (IMB) is a form of permit issued by the
Regional Head to building owners to modify, expand, reduce and/or maintain
buildings in accordance with applicable administrative and technical requirements.
IMB is a legal product to realize spatial planning so as to create order, security,
safety, comfort, as well as legal certainty. In practice, spatial planning is one of the
many fundamental legal aspects for the State. Solving the problem formulation
regarding implementation, constraints and government efforts through the Malang
City Regional Regulation (Pasal 42 Peraturan Daerah Kota Malang Nomor 4 Tahun
2011 tentang Rencana Tata Ruang Wilayah Kota Malang) on buildings on the river
border. The implementation, obstacles and government efforts to overcome these
obstacles are described using empirical juridical methods and the research focus is
described using qualitative descriptive methods. The structured explanation of the
problem formulation leads to the conclusion that less than optimal implementation
of the law involves factors from the effectiveness of the law to measure the
implementation of a regulation. The state is responsible for spatial planning,
controlling and managing the earth, water, space and natural resources for the
welfare and prosperity of the people. Spatial planning is carried out for the sake of
sustainable development in order to realize space utilization in accordance with
applicable legal principles. With violations of spatial planning laws, such as
buildings built on river border land which should have the function of being a water
catchment area, these areas have now experienced a decline in availability due to
the construction of buildings or their conversion as residential areas. So, it is very
necessary to reorganize the areas that form the boundaries of the river borders. It
should be noted that before constructing a building and submitting an IMB
application, the land owner must know the various boundary lines on the land they
own in order to ensure compliance with spatial planning laws in the development
aspect.
