Abstract

Unlawful acts are actions or behavior of a person that are contrary to the applicable laws and regulations. This action can include various forms of violations in the criminal, civil, and administrative domains that cause harm to individuals, communities, and the state. The main elements in an unlawful act include the existence of an act, the causal relationship between the act and the result, and the contradiction of the act with the applicable legal norms. The purpose of this writing is to identify and analyze the settlement implementation process and legal considerations of the panel of judges who examined, decided and adjudicated the dispute of unlawful act lawsuit in case number 189/Pdt.G/2023/PN.Kpn. The method used in this writing is juridical-empirical with the type of court decision case. The results of the writing show that the panel of judges who examined, decided and tried case number 189/Pdt.G/2023/PN.Kpn. and case number 332/PDT/2024/PT.SBY. showed significant differences. Because the Judex Facti of the Surabaya High Court did not apply the principle (audi et alteram partem) by not considering the evidence submitted by the Plaintiff in the First Level examination. The suggestions given from the writing of this final project are intended to provide insight to digital Bank user customers to be more careful in doing something so that there is no loss of personal data when clicking on links that are not clear sources.
