Abstract
The use of digitalization by banks which makes transactions easier via electronic media was the establishment of Internet Banking (e-banking) which later developed into Mobile Banking (m-banking), but it was found that there were many legal violations against customers' personal data, including cyber attacks that experienced by banks in Indonesia using the personal data of customers using Mobile Banking. In relation to this, the aim of the research is to find out and explain the conditions regarding the leakage of personal data of bank customers who use Mobile Banking and to find out the legal protection arrangements for the personal data of bank customers who use Mobile Banking in Indonesia, as well as present recommendations regarding the construction of legal protection, both preventive and repressive. ideal for the personal data of Bank Customers using Mobile Banking. The method used in this research is normative juridical with techniques for collecting library study materials according to the statutory regulatory approach. The research results show that, of the existing regulations that only regulate the protection of conventional personal data, there is still nothing that specifically regulates the protection of personal data of Mobile Banking users. The conclusions and suggestions from this writing are a form of legal protection that is responsive to the personal data of customers using Mobile Banking which can be outlined in the Financial Services Authority (PJOK) Regulations, including clarifying the scope of personal data of Mobile Banking users, preventive protection in the form of formulative or legislative law enforcement. and applicable law enforcement, namely the formation of a cyber agency to monitor, identify and guard cases against banks in Indonesia. Apart from preventive protection, there is repressive protection in the form of formulation/legislative policies, dispute resolution policies (customer complaints, through the Indonesian Alternative Banking Dispute Resolution Institute (LAPSPI), and resolution through the courts).).
