Abstract

Transaction for uncertified land-ownership without being done in front of Pejabat Pembuat Akta Tanah which is commenced by the people in Desa Talun Kulon Kecamatan Bandung Kabupaten Tulungagung has shown that article 37 clause (1) PP No. 24 year 1997 about registration stated that transaction of land ownership is able to registered if the realization of transaction is being done in front of PPAT is not yet effective. This study is taken problem formulation as follows: 1. Why do people in Desa Talun Kulon Kecamatan Bandung Kabupaten Tulungagung have done land-ownership transaction without Akta Pejabat Pembuat Akta Tanah (PPAT)? 2. How does the role of local government to enforce the land-ownership transaction using Akta Pejabat Pembuat Akta Tanah (PPAT)? 3. What are the obstacles in enforcing the implementation of land-ownership transaction using Akta Pejabat Pembuat Akta Tanah (PPAT)? This study is using sociological jurisdiction method; data collection technique is interviewing respondent/sample taken from the land-buyer population within the community in Desa Talun Kulon Kecamatan Bandung Kabupaten Tulungagung who has done uncertified land-ownership transaction without Akta PPAT and proper documentation as primary data. Subsequently, data is analyzed descriptively. Among 9 person who had done uncertified land-ownership transaction and done without Akta PPAT, author obtained reasons for not doing the transaction using Akta PPAT mostly based on economy, education and cultural reasons. People haven’t done land-ownership transaction in front of Kepala Desa because they didn’t know about transaction procedures in front PPAT, lower educational level and high tolerance among society has affected the implementation of land-ownership transaction and becoming obstacle in implementing uncertified land-ownership transaction without using Akta PPAT in Desa Talun Kulon Kecamatan Bandung Kabupaten Tulungagung. The local government’s role in Desa Talun Kulon Kecamatan Bandung Kabupaten Tulungagung to urge the implementation of land-ownership transaction using Akta PPAT is by giving elucidation toward the local government’s officials, the people and by implementing scrutiny principle during document checking and anything related with the land as the object of transaction.
