Abstract

Marriage is not only related to patterns of human relationships but also has a dimension of faith or belief. Article 2, paragraph (1) of Law Number 1 of 1974 on Marriage states that a marriage is considered valid if it is conducted according to the beliefs, religion, or faith of the parties involved. One example of a cultural blend in marriage is the Nyuwang Nganten tradition in Dusun Kecicang Islam, Desa Bungaya, Kecamatan Bebandem, Kabupaten Karangasem, Bali. This tradition has three stages and causes divisions in society regarding its permissibility. This study highlights the divided attitudes of the community in supporting and opposing the tradition. According to Ahmad Qodri Abdillah Aziziy, Indonesian law should be viewed as a fusion of Islamic law, positive law, and customary law. This research aims to describe the implementation of the Nyuwang Nganten tradition and to identify and analyze its future according to Ahmad Qodri Azizy's eclecticism theory of law. Based on a mixed-method research approach, the study concludes two main points. First, the Nyuwang Nganten tradition in Kampung Kecicang Islam, Karangasem, Bali consists of three stages: ngendak (initial agreement), ngideh (formal request with offerings), and Nyuwang Nganten (taking the bride to the groom's house). Second, the future of this practice, according to Ahmad Qodri Azizy's eclecticism theory of law, involves codification to protect the tradition through regional regulations.
