EFEKTIVITAS PENEGAKAN HUKUM TERHADAP PENATAAN DAN PEMBERDAYAAN PEDAGANG KAKI LIMA DI KABUPATEN PAMEKASAN

In realizing the arrangement and empowerment of street vendors as well as traffic safety, city beauty, and public order, special laws and regulations are needed to regulate these activities. However, what if the City or Regency Government in this case has made efforts by providing several locations that can be occupied by street vendors, the provision of these locations aims to not interfere with traffic, environmental cleanliness, and the beauty of the city layout. The method used in this study is empirical juridical. This research was conducted by seeking information from a problem that occurred directly at the research location that had been determined using interviews. This study produced several conclusions, first, the inhibiting factors for the effectiveness of the arrangement and empowerment of street vendors in Pamekasan Regency are obstacles from law enforcement factors, namely the lack of personnel during the control, obstacles from facilities and infrastructure, namely the lack of trucks, obstacles from community factors regarding their lack of understanding of applicable regulations, obstacles from cultural factors, namely the lack of politeness when the control was carried out. The supporting factors are the legal factors themselves which are in accordance with the needs of the community. Second, the efforts made by members of the Pamekasan Satpol PP are preventive enforcement in the form of education and repressive enforcement in the form of control and administrative sanctions.
