PELANGGARAN HAK CIPTA MELALUI APLIKASI TELEGRAM SEBAGAI MEDIA STREAMING FILM

Modern human life today is heavily dependent on gadgets as the times evolve and advances in digital technology. A lot of things are affected by the Internet in today's age of globalization, especially in the field of copyright. One example of copyright infringement is the increasing distribution of movies through the Telegram app. Telegram is a messaging application that is often misused as an illegal movie streaming media because inside it has a considerable storage capacity. Because of the ease of access and the public's need to watch movies, people started streaming illegally through the app. There are three types of violations that violate the economic rights of a copyright holder, namely: the announcement of the copyright, the labelling of the author's work, and the piracy of the work. Sanctions imposed on copyright infringers can be brought through civil proceedings or the imposition of fines or criminal sentences of imprisonment. There is a low level of public awareness of whether or not a copyright infringement is taking place. To solve the problem of telegram applications that are used as a means of streaming films illegally requires a solution or a way out and rigour from the authorities. The Law No. 28 of 2014 on Copyright regulates the criminal provision concerning the violated hole of complaint. In this study it was found that the rules enforced in the Act No. 28, 2014 on copyright currently in force should be a common hole because nowadays almost everyone can access it easily and freely when they want to watch a movie on the Telegram channel and in order to facilitate the authorities in law enforcement. The legal sources used in this research are the primary legal material contained in the Act No. 28 of 2014 on Copyright and the Law No. 19 of 2016 on Amendment of the Act no. 11 of 2008 on Electronic Information and Transactions.
