His thesis is entitled "Criminal Responsibility of Gojek Drivers due to Negligence which results in accidents", Humans need means of transportation to move from one place to another in a short time. Online motorcycle taxis (Gojek) are an alternative means of transportation that is being widely used by the public due to technological advances. In this thesis there is a problem formulation, namely how the criminal liability of Gojek drivers due to negligence causes the loss of the victim's life according to Law Number 22 of 2009 concerning Road Traffic and Transportation and how to resolve accident cases that cause the victim to die according to Law Number 22 The year 2009 ? The research method is categorized as normative legal research, where the author examines document studies, namely using various secondary data such as statutory regulations, court decisions, legal theory, and can be the opinions of scholars. From the results of the research, it can be concluded that a driver who is negligent in driving and causes the victim to die in a traffic accident is criminally liable for committing a criminal act, is capable of taking responsibility, there is no excuse for forgiveness. In the case of a Gojek accident on Jl.Mastri Surabaya has fulfilled the elements of criminal responsibility for accidentally taking the victim's life due to negligence in driving. For the defendant's actions, he received a criminal charge under Article 310 Paragraph (4) of Law no. 22 of 2009 concerning Road Traffic and Transportation
