Abstract

The Government of Indonesia specifically regulates copyright in Law Number 28 of 2014 concerning Copyright. This is one of the reasons why there are many copyright violations in the developing times, one of which is the case of the sale of Spotify Premium accounts by third parties. The purpose of this study is to find out the legality of selling Spotify Premium by third parties and to know the appropriate legal action for third parties who sell Spotify Premium accounts. This study uses a normative research method that refers to legal norms, theories and concepts related to the subject of the research, and uses a case approach that provides an overview of the impact of a legal rule in legal practice. The result of this research is based on article 9 paragraph (1) of Law Number 28 of 2014 concerning Copyright states that copyright holders have exclusive rights to others and distribute their works, but in this case third parties do not have official permission from Spotify. Then based on the Criminal Code article 1320 related to halal causes, third parties have no halal reasons in selling Spotify. So that legal action that needs to be taken is by claiming financial losses as in article 1365 of the Criminal Code concerning liability for unlawful acts. Suggestions for Spotify to increase education to its users regarding the legal consequences of their actions, in addition to improving the mechanism for monitoring the platform's activities, then collaborating with legal authorities to strictly crack down on violations in its services, as well as suggestions to the government to further strengthen law enforcement regulations related to copyright infringement and illegal transactions in the digital world.
