PENERAPAN PEMENUHAN SYARAT UMUM PASAL 5 PERATURAN KEPOLISIAN NOMOR 8 TAHUN 2021 TENTANG PENANGANAN TINDAK PIDANA BERDASARKAN KEADILAN RESTORATIF DALAM PELAKSANAAN RESTORATIVE JUSTICE (Studi Kasus Di Polres Lumajang)

Restorative Justice is one of the efforts to resolve legal cases implemented in Indonesia and focuses on the restoration and restoration of relationships that have been damaged by criminal acts committed by perpetrators. The application of restorative justice also has conditions that must be met by the community which will carry out the settlement of a case through restorative justice. In handling cases carried out by Police Investigators, they must comply with the regulations that have been set, therefore all Police actions must be based on the law that has been applied. The focus of this study is on how to use the general requirements as referred to in Pasal 5 of Police Regulation Number 8 Tahun 2021 Regarding the handling of criminal acts based on restorative justice in the implementation of the Criminal Investigation or Investigation Function at the Lumajang Police Station. The research method used in this study is sociological juridical where this research is carried out by looking at something or the reality of the law in society. From the results of the research carried out, there are two cases with case settlement through restorative justice. In the first case with the police report number LB/01/I/2023/SPKT/POLRES LUMAJANG/POLDA EAST JAVA, the perpetrator was proven to have committed an unlawful act by committing an act of rape. Then in the second case with court decision number 267/Pid.B/2022/PN lmj, the defendant committed the crime of persecution due to land/building disputes. The settlement of the two cases through this restorative justice process has a difference, namely in fulfilling the general requirements of Pasal 5 of Police Regulation Number 8 of 2021 Regarding the handling of criminal acts based on restorative justice in.
