Abstract
In the midst of the development of technology and information, the use of electronic media is often misused, one of which is cyber prostitution transactions among students. Students who are in fact prospective academics (educated) who should uphold and hold fast to ethical, academic and morality values, instead dabble in cyber prostitution which clearly damages the image and integrity of higher education as a place for educated people. So that the participation of students in providing cyber prostitution services certainly has a very bad (negative) impact on the future generation of the nation. The juridical problems that are the focus of this legal research are the first legal construction of cyber prostitution through electronic media based on the current Electronic Information and Transaction Law. Second, how is the effort to handle cyber prostitution among students through electronic media in the jurisdiction of Malang City. The purpose of the legal research conducted by the author is to identify and analyze the legal construction of cyber prostitution through electronic media based on the current ITE Law and to identify and analyze the handling efforts that must be made in overcoming cyber prostitution through electronic media in Malang City carried out by 3 (three) agencies / institutions namely Malang City Police, Malang City Satpol PP, and Malang City PHRI. The results showed that the legal construction of cyber prostitution within the framework of the ITE Law does not only ensnare the person as a legal subject as referred to in Article 27 paragraph (1) which is threatened with Article 45 paragraph (1), but if cyber prostitution is carried out by a corporation, it will be punished with the basic punishment plus 2/3 which is regulated in the provisions of Article 52 paragraph (4). Furthermore, between Malang Police, Malang City Satpol PP, and Malang City PHRI have collaborated and played an active role in efforts to prevent cyber prostitution crimes in Malang City by coordinating between institutions.
