Abstract

Land disputes are disputes caused by errors in the designation of land parcels or boundaries. This dispute can cause losses to parties who have an interest in the land parcel. Settlement of land disputes, including disputes over the location of land parcels, can be resolved through litigation and non-litigation channels. Settlement of land disputes through non-litigation channels can be done through mediation. Mediation as an alternative dispute resolution is considered more favorable for the parties because it uses the win-win solution method. This research is an empirical juridical research, using primary and secondary data sources. The research location is at the Kediri District Land Office. The result of this research is the implementation of mediation at the Kediri District Land Office through several stages guided by Article 6 paragraph (1) of the Regulation of the Minister of Agrarian and Spatial Planning / Head of the National Land Agency Number 21 of 2020 concerning Handling and settlement of Land Cases. The obstacles in the implementation of mediation at the Kediri District Land Office are the absence of the parties and the absence of good faith from each party to the dispute. In this case, the solution that can be provided by the Kediri District Land Office is to advise the parties to resolve the dispute through litigation at the Kediri District Court.
