Abstract

This research aims to find out, explain and analyze diversion arrangements in resolving juvenile criminal cases; To find out, explain and analyze the ideal concept of diversion in resolving juvenile criminal cases. Based on analysis of data and facts, the author concludes that diversion in resolving child criminal cases in Indonesia is regulated in Law no. 11 of 2012 concerning the Juvenile Criminal Justice System, Government Regulation no. 65 of 2016 concerning Guidelines for Implementing Diversion and Handling Children Who Are Not Yet 12 (Twelve) Years Old. At the first diversion level, namely at the investigation level (2) The ideal concept of diversion in resolving child criminal cases is diversion in the form of mediation with deliberation involving child perpetrators and victims, parents of child perpetrators and victims, community counselors and professional social workers, to achieve restorative justice.
