IMPLEMENTASI PERLINDUNGAN HUKUM TERHADAP PEMEGANG HAK ATAS TANAH TERHADAP TERBITNYA SERTIFIKAT TANAH GANDA ( STUDI KASUS KANTOR PERTANAHAN KOTA MALANG)

Aspects of human life Land registration has an important meaning, initiallyland
was a basic requirement for residential buildings. Therefore, it is necessary toregister
land rights to produce a land certificate which is then issued by the National Land
Agency (BPN) as legal proof of ownership and provides legal certainty for land
certificate holders. This research discusses the implementation of legal protection for
land rights holders regarding the issuance of dual certificates according to Government
Regulation Number 24 Land 1997 at BPN Malang City. Aims to determine the form of
legal protection for dual certificate holders and legal remedies for holders of dual
certificated land rights. Analysis uses an empirical juridical approach by conducting
interviews with Malang City BPN officials, then combining it with various literature
sources related to land rights. Based on the results of the analysis, the form of legal
protection for land rights holders is based on the Decree of the Head of the National
Land Agency of the Republic of Indonesia Number 34 of 2007 Technical Instructions
Number 05/JUKNIS/DV/2007 if there is a double certificate, the settlement effort by
BPN Malang City is mostly through mediation. Then, for the legal action provided by
BPN, they are willing to become expert witnesses.
