Abstract
The regulation of Justice Collaborator has been mentioned in several laws and regulations in Indonesia, but the regulation and application of Justice Collaborator in Indonesia is still insufficient, which does not have a specific legal basis in the national legislative system. Thus, this research will discuss the legal protection of Justice Collaborators in positive law in Indonesia, and discuss the legal protection of Justice Collaborators in the perspective of legal certainty. The research method in this paper is to use normative research, with a statutory and conceptual approach. While the sources of legal materials include primary, secondary, and tertiary legal materials. The legal materials are collected using literature study techniques which are then analyzed in a qualitative description. Based on the results of research and discussion, it is found that the legal protection of Justice Collaborators is inadequate, because the regulation of the Justice Collaborator determination mechanism is located in legislation under the law, and the role of LPSK is not in accordance with the principles of the Integrated Criminal Justice System, because there is still segmentation of the determination of Justice Collaborators into several institutions, such as the KPK, BNN, BNPT and the Attorney General's Office. Furthermore, in the perspective of legal certainty, legal protection against Justice Collaborators is also still not fulfilled, because one of the elements that must be fulfilled in ensuring legal is in the form of positive legislation. This can be seen from several weaknesses in the existing laws and regulations, namely that there is no special mechanism for reporting by Justice Collaborators, the overlapping authority of institutions that handle reporting and protection of Justice Collaborators, still not regulated regarding punishment of individuals who violate the rights of Justice Collaborators, and the ambiguity of giving awards to Justice Collaborators. Therefore, it is necessary to revise and harmonize the relevant laws and regulations concerning the determination of justice collaborators, the provision of rewards, and strengthen the role and authority of LPSK as a justice collaborator examination institution.
