Abstract

Civil litigation by electronic proceedings (E-litigation) in the Lumajang State Court refers to the Supreme Court Regulation No. 7 of 2022 on the Electronic Administration of Matters and Trials in order to a simple, fast and low-cost justice using information and communication technology. This paper aims to find out the effectiveness of civil settlement by e-litigation in the jurisdiction of the Lumajang State Court. As for the method used in this research, it is empirical juridic research with data collection techniques such as observations, interviews and documentation to study the formula of the problem is 1) How is the effectiveness of perma number 7 year 2022 related to e litigation in settlement of civil matters in the state courts flourished? 2) Are the obstacles and efforts of the state courts flourishing in settling civil matters by e-litigation related to perma no. 7 of 2022?. The conclusion and suggestion of this writing is to show that the effectiveness of settlement of civil matters by e-litigation in the jurisdiction of the State Court of Lumajang there are 3 factors that are said to be effective, namely, legal factors, law enforcement factors, cultural factors, and 2 factors which are said not effective, i.e. advice and advice factors, community factors. However, there are obstacles to civil litigation via e-litigation, the first is the substance of the law, regarding the enforcement of the recorded letter, the proof process, and the second, the technical obstacle, namely the lack of public understanding of the procedure of electronic trial, the uneven Internet network across the entire layer of society. Therefore, the state courts attempt to socialize with the post office and conduct open socialization of education and procedures from e-court to the implementation of e-litigation in the Negei Lumajang Court, monitoring and evaluation.
