Abstract

The issue of integrating the concept of human rights from Muhammad Arkoun's perspective into the 1945 Constitution after undergoing a series of amendments is indeed an interesting thing to study. Through a conceptual analysis approach, this research aims to understand how the concept of human rights finds its relevance in the context of the Indonesian constitution that has undergone changes. By exploring the thoughts of Arkoun, who is known as a Muslim intellectual who campaigns for openness and reinterpretation of religious understanding, this research explores how the concept of human rights can be applied in the Indonesian legal framework after the amendment of the 1945 Constitution.
This study presents the theoretical basis of Muhammad Arkoun's concept of human rights, taking into account his perspective inspired by cultural and religious contexts. By examining Arkoun's works, this research identifies the main principles underlying his thoughts on human rights, such as religious freedom, gender equality and social justice. As such, it provides a strong foundation to explore how these concepts can be integrated into the amended 1945 Constitution. In order to examine the development of the post-amendment 1945 Constitution that is relevant to the concept of human rights in Arkoun's perspective. Through an analysis of the amendments that have been made, this study identifies points where human rights values have been accommodated or may conflict with previous constitutional provisions. Thus, this study can provide a comprehensive picture of the transformation of the Indonesian constitution in the context of human rights.
The results of this study offer a new perspective on how the concept of human rights according to Muhammad Arkoun can enrich the understanding and implementation of the post-amendment 1945 Constitution. By exploring the possibility of integrating Arkoun's concept into the existing legal framework, this research seeks to offer concrete solutions that can enhance the protection of human rights in Indonesia. Through this approach, it is hoped that this research can make a significant contribution to efforts to strengthen the foundation of human rights in Indonesia in the nuances of Islamic thought.
