PEMENUHAN HAK RESTITUSI TERHADAP ANAK SEBAGAI KORBAN TINDAK PIDANA KEKERASAN SEKSUAL (Studi Kasus Putusan Nomor 00/Pid.Sus-Anak/2023/PN Kba)

This study is a case study of Decision No. 00/Pid.Sus-Anak/2023/PN Kba) which examines the implementation of the right to restitution of children as victims of sexual violence. This research uses normative research methods with qualitative descriptive research writing techniques. The research approach used is the legislative approach (Statute Aproach) and also the case approach (Case Aproach), by examining the judgment No. 00/Pid.Sus-Anak/2023/PN Kba and further analysing the Government Regulation No. 43 Year 2017 related to the murder of the right of restitution of children who have become victims of criminal acts of sexual violence. Based on this study, it was found that the judge in his legal consideration regarding the case No. 00/Pid.Sus-Anak/2023/PN Kba has considered on the basis of fair consideration of the victim and also the perpetrator. Government Regulation No. 43 of 2017 has already guaranteed legal protection for children as victims of a crime. However, these rules are still difficult to reach and easily fulfilled by the civil society as a victim of filing because of the many conditions that they have to meet without a clearly defined accompanying body.
