Abstract

The research was conducted to (1) determine the legal consequences and juridical impacts resulting from the issuance of two land title certificates, (2) determine the regulation of accountability for the issuance of more than one land title certificate by the Agency. National Land Affairs. This type of research uses normative juridical methods and is carried out by examining various kinds of formal legal rules such as laws, government regulations, ministerial regulations and theoretical literature which is connected to the problems being discussed which are conceptual in nature. The research resulted in (1) the legal consequences arising from the existence of multiple certificates of land rights, namely legal uncertainty, causing major losses for both parties, reducing the level of public trust, and the cancellation of one of the certificates based on the Decision of the State Administrative Court which has permanent legal force, (2) The National Land Agency (BPN) is absolutely responsible both in the form of personal and institutional accountability. Personally, the Head of the Land Office as the holder of the position is subject to administrative sanctions ranging from light, moderate to heavy. As an institution, BPN is obliged to facilitate the mediation process and is legally responsible, namely facing the parties' lawsuits in court and canceling any certificates whose validity is legally doubtful.
