ANALISIS PENGATURAN MASA JABATAN KETUA UMUM PARTAI POLITIK DITINJAU DARI TEORI DEMOKRASI

A political party is an institution that acts as a pillar in a country's democratic journey, thus there needs to be democratization in the internal implementation of political parties. One important aspect in implementing democratic values within political parties is the term of office of the general chairman of the political party. The problem raised in this research is how to regulate the term of office of the general chairman of a political party in terms of Indonesian positive law and what are the legal implications regarding the regulation of the term of office of the general chairman of a political party in terms of democratic theory? This research uses a juridical-normative type of research with approach methods in the form of a conceptual approach and a statutory approach. The legal materials in this research use legal materials in the form of primary legal materials which refer to the juridical basis relating to the object of research and secondary legal materials which come from non-official documents in the form of publications on the internet and related books. The law collection technique in this research uses library research and legislative studies which are then analyzed using descriptive-qualitative methods. Based on the research results, it was found that the regulation of the term of office of the general chairman of a political party is regulated in Law no. 2 of 2011 concerning Political Parties which provides implementation to the AD/ART of each Political Party, where the norms for the term of office of the general chairman of a political party create 2 forms in the form of a limitation on the term of office of the general chairman of a political party and no limitation on the term of office of the general chairman of a political party . In fact, the implication of the absence of restrictions has an impact in the form of overriding the internal democratization of political parties, which is not in accordance with the indicators of democracy in the form of rotation of power. Due to this, researchers consider it necessary to revise Law no. 2 of 2011 concerning Political Parties to add legal norms in the form of limiting the term of office of the general chairman of a political party..
