EFEKTIVITAS MEDIASI SEBAGAI UPAYA PENYELESAIAN WANPRESTASI DALAM JUAL BELI TANAH (STUDI DI DESA NGUWOK KECAMATAN MODO KABUPATEN LAMONGAN)

This final assignment was motivated by complaints from land sellers who complained about their problems to the Nguwok Village Government. Then mediation was carried out between both parties and the Head and Officials of Nguwok Village became the bridge to resolve the dispute as mediators. Mediation is carried out to resolve these problems in order to provide results that benefit both parties. This research uses a juridical-empirical method with a qualitative descriptive approach. Researchers will examine efforts to resolve defaults in land sales and purchases through mediation and the effectiveness of mediation as an effort to resolve defaults in land sales and purchases in Nguwok Village, Modo District, Lamongan Regency. The results of this research show that in efforts to resolve this dispute the parties chose to make peace. The process followed in this case is in accordance with Perma Number 1 of 2016 concerning mediation. And resolving this dispute using a peace deed is the best way because it is mutually beneficial for both parties. Based on its practical use, it can provide insight for law enforcers, especially villages, in efforts to resolve land sale and purchase defaults through mediation. For sellers and the general public as the aggrieved party so that it can provide benefits to both parties in the dispute.
