Abstract
Diversion is considered the best approach in handling cases of children committing offenses under certain conditions. Utilizing a restorative approach, also known as diversion, allows for the assessment of the impact on child rehabilitation and the reduction of recidivism rates. The numerous cases of assault committed by children for various unjustifiable reasons can negatively impact their future. However, not all cases are eligible for diversion, even if they meet the criteria. The police must also analyze the potential impacts if a child undergoes diversion to minimize the chance of unwanted incidents recurring. This paper formulates issues regarding the diversion process conducted through consultation involving the child and their parents/guardians, victims and/or their parents/guardians, community mentors, and professional social workers based on a restorative justice approach in assault offenses committed by children in conflict with the law. The purpose of this study is to understand how the diversion process is conducted through consultation involving these parties based on restorative justice in assault offenses by children in conflict with the law. This study uses an empirical juridical approach with primary and secondary data sources, employing interview techniques and literature studies. Data will be analyzed using qualitative analysis techniques. The suggestion from this research relates to police compliance with the Juvenile Criminal Justice System Law and fulfilling children's rights concerning diversion efforts.
