Abstract

This research focuses on the legal consequences faced by children born from mixed marriages, as well as how legal protection is provided under Indonesian law. The main issues examined include the citizenship status of children of couples with different nationalities and the legal protection measures needed to guarantee children's rights. The research method used is normative research with a statutory and conceptual approach. The primary legal materials in this research are Undang-Undang Nomor 1 Tahun 1974 on Marriage and Undang-Undang Nomor 12 Tahun 2006 on Citizenship. Secondary legal materials are obtained from various journals, books, and papers relevant to this topic. The results show that children born from mixed marriages have the right to choose their citizenship when they reach the age of 18. The legal protection for these children still requires improvement and adjustment to ensure that their rights are not ignored and they can obtain the appropriate nationality without discrimination. This research makes a theoretical contribution in enriching the legal literature on mixed marriages and their impact on children, and presents practical recommendations for policymakers to strengthen regulations that protect the rights of children from mixed marriages.
