Abstract

The identity of child victims in cases of violence needs to be protected from various media and news. Therefore, disclosing the identity of the child cases of violence through electronic media is a violation, namely Article 19 paragraph (1) of the Juvenile Criminal Justice System Law. The press is a medium of information, education and entertainment, but also needs to consider its function as social control, in accordance with Article 3 paragraph (1) of the Press Law. Article 6 point b and the Journalistic Code of Ethics states that the Press is obliged to uphold human rights. Article 7 paragraph (2) of the Press Law states that journalists work in accordance with the Journalistic Code of Ethics. Article 32 paragraph (3) of the Electronic Information and Transaction Law, every person is prohibited from providing access to electronic information that is confidential to public information with improper data integrity, on the basis of harming others (Article 36 of the Electronic Information and Transaction Law). The form of legal protection for violations of the child identities publication through electronic media in the Juvenile Criminal Justice System is in Article 64 paragraph (2) number 7 of the Child Protection Law and Article 3 point 9 of the Juvenile Criminal Justice System Law that the child receives special protection by not publishing their identities through the mass media to avoid labelling. In Article 5 points a and i of the Witness and Victim Protection Law, the child are protected by their rights and receive special protection to obtain protection of personal and family security and children also need to keep their identity confidential.
