Abstract

The research was conducted to (1) to understand the diversion process carried out through deliberation involving the child and their parents/guardians, the victim and/or their parents/guardians, community advisors, and professional social workers based on a restorative justice approach in assault cases at the investigation stage at the Sumbawa Departemental Police Force (2) to discover how the police fulfill the mandatory diversion provisions by considering the interests of the victim and avoiding negative stigma for the child as the perpetrator. This type of research employs a methodological approach, using a socio-juridical approach to examine the issues. This approach focuses on social aspects and the applicable laws and regulations as guidelines for discussing the issues. It is also related to the realities in practice and the influential social aspects. The research results showed that (1) in the diversion process that takes place in Sumbawa, the police do not involve professional social workers, since there are no professional social workers in Sumbawa (2) The interests of the victim are still not fully considered by the police, and it is challenging to prevent the child as the perpetrator from being subjected to negative stigma by the community.
