Tanggung Jawab Hukum Rumah Sakit terhadap Perlindungan Kerahasiaan Medis dalam Pengelolaan Data Rekam Medis Elektronik

In 2022, the Indonesian Ministry of Health issued Minister of Health Regulation number 24 on Medical Records which requires all health care facilities in Indonesia to organize medical records in electronic form, where the information system is required to be integrated with the information system managed by the ministry of health. In the implementation of this obligation, hospitals can potentially perform a disclosure of patient medical secrets by providing access to the entire contents of electronic medical records. So that this research was conducted to analyze how the legal responsibility of the hospital on the obligation to implement this electronic medical record is associated with access and analyze the legal protection of the confidentiality of patient data in medical records. The research was conducted with a normative juridical method using a statutory approach. Based on the results of the analysis, it was found that the regulation of opening access to electronic medical records to the information system of the Ministry of Health has the potential to violate the medical confidentiality of patients treated at the hospital so that it can put the hospital in a position to be legally responsible. So that a clear legal protection is needed aimed at hospitals as organizers of electronic medical records. With the aim of carrying out its obligations, the hospital is also protected from the possibility of potential accusations of revealing the patient's medical secrets.
