Abstract

The implementation of occupational safety and health plays an important role in the company to work safely at work and minimize dangerous conditions that result in accidents and occupational diseases, thus enabling workers to carry out their duties in safe and comfortable conditions, with the hope that workers have good performance and company productivity is achieved. All parts of the company are responsible for the achievement of occupational safety and health. The company is obliged to provide a safe working environment for its employees. BPJS Employment in the last 3 years has recorded an increase, with a total of 221,740 cases in 2020, in 2021 234,370 cases, and 2022 reaching 265,334 cases. The ILO notes that every year nearly 3 million workers die from work-related accidents and diseases. This study is a normative legal research, which means studying literature or secondary data that includes primary, secondary, and tertiary legal materials. Occupational safety and health regulations are harmonized and consistent as well as inconsistent. Where these rules complement and explain each other. This is contained in the Law, government regulations, and ministers. The protection obtained by workers or laborers in mining should be obtained by all without exception, because the regulations are clear in protecting workers in occupational safety and health. Legal protection of rights and occupational safety and health in companies specifically in the mining sector has been clearly explained in occupational safety and health regulations and labor laws. The consequences if not implemented have also been clearly explained, so that the rules have made certainty of safety and health guarantees in working in mining companies.
