Abstract

Chemical castration has now become a criminal penalty based on the latest Child Protection Law, enacted in response to the rising reports of sexual violence against minors. There are advantages and disadvantages to the use of chemical castration concerning human rights, legal objectives, and medical concepts. This study aims to examine the regulation of chemical castration as an additional criminal penalty for perpetrators of sexual violence against children, as well as the impact of this law and its potential benefits. A normative juridical approach was employed in this study. The research applied a conceptual approach, a legislative approach, and a comparative approach to the issue. Literature and secondary data sources were qualitatively evaluated and used as the primary sources. The research findings indicate that chemical castration, as stipulated in Law No. 17 of 2016, violates fundamental medical ethics and human rights. If the chemical castration penalty is imposed on perpetrators who do not suffer from pedophilia, it serves merely as retribution or retaliation for the harm caused by the perpetrator, rather than as a rehabilitative or deterrent effect.
