Abstract

The investigation process is an initial stage where a child is confronted by investigators or the police. The child suspect was placed in the same cell as the adult prisoner. This is clearly contrary to Law Number 11 of 2012 concerning the Child Criminal Justice System and Law Number 35 of 2014 concerning amendments to Law Number 23 of 2002 concerning Child Protection. It is very necessary to consider various things for the future of the child and pay full attention to the rights of the child not only to protect the child who is a victim of a criminal act, but also to the child who is the perpetrator of a criminal act. The research method used is juridical, sociological and the approach uses a case approach. The location of the research was at the Paser Resort Police, Paser Regency, East Kalimantan Province. The results of the study are: First, the consideration of the investigators of the Paser Resort Police in East Kalimantan placed the child suspect with the adult suspect from the perspective of protecting children's rights that the investigator only considered the detention room facilities at the Paser Resort Police were still limited so that the placement of the child suspect was placed with adults. The actions experienced by the child during the detention period do not reflect the values of protection for the child. That the legal factor that governs children must be placed separately is ineffective because the placement of children is placed as one with adults. Second, the application of sanctions for East Kalimantan Paser Resort Police Investigators who place child suspects with adult suspects shows that in practice there have been no sanctions for investigators who place child suspects with adult suspects. Although the law has regulated the separation of child suspects from adults, this is not accompanied by sanctions for investigators. The suggestion that can be given is that it is necessary to add a detention facility at the Paser Resort Police that separates child suspects from adults.
