ANALISIS HUKUM TERHADAP PROFESIONALISME HAKIM TINDAK PIDANA KORUPSI DI PENGADILAN TINGKAT PERTAMA (Studi Penerapan Ketentuan Pasal 10 Ayat (3) Undang-Undang Nomor 46 Tahun 2009 Di Pengadilan Negeri Surabaya)

This research focuses on the implementation of professionalism by judges for criminal acts of corruption at the first level, and also analyzes the provisions of article 10 paragraph (3) of Law 46 of 2009 concerning trials for criminal acts of corruption. The formulation of the problem in this research is: How does the professionalism of judges for corruption crimes apply in carrying out justice at the first level. What is the Concept of Ideal Arrangements to Realize the Professionalism of Judges for Corruption Crimes at the First Level. This research uses empirical juridical research, using a qualitative approach. The location of this research is the Surabaya corruption court. Legal material sources use primary and secondary data sources. The technique for obtaining data was carried out using 2 types of studies, namely interview studies and literature studies. The data analysis technique in this research uses descriptive analysis. The result of the discussion from this research is an understanding regarding professionalism, that professionalism must be supported by high integrity. The application of professionalism of judges at pn.sby has been carried out well in accordance with applicable regulations. And all criteria and aspects supporting the professionalism of judges have been fulfilled. Then in the event that he is not free to assign a career judge based on article 10 paragraph (3) because there are supporting factors and reasons. The quality of a professional judge's decision must contain 3 substances, namely justice, certainty, expediency, all of which have been fulfilled. The ideal regulatory concept regarding the professionalism of judges for corruption crimes, by looking at the facts in the field, what the reality is like, and there must be an evaluation of the existence of article 10 paragraph (3) of law number 46 of 2009.
