ANALISIS PASAL 34 UNDANG-UNDANG NOMOR 1 TAHUN 2023 TENTANG KITAB UNDANG-UNDANG HUKUM PIDANA BAGI KORBAN PENCURIAN DENGAN KEKERASAN DITINJAU DARI ASPEK KEPASTIAN HUKUM DAN KEADILAN HUKUM

Basically, victims of a criminal offence must be protected by the state through legislation. This study aims to determine the enactment of Article 34 of Law Number 1 of 2023 concerning the Criminal Code for victims of violent theft in terms of legal certainty and legal justice, so that the formulation of the problems raised is; first, how is the formulation of Article 34 of Law Number 1 of 2023 concerning the Criminal Code for victims of violent theft in terms of legal certainty; second, how is the formulation of Article 34 of Law Number 1 of 2023 concerning the Criminal Code for victims of violent theft in terms of legal justice? Then this research uses normative juridical methods, with the type of secondary legal material in the form of primary, secondary and tertiary legal materials and is carried out using conceptual and statutory approach methods. The results showed that; first, legal certainty provided by the state through Article 34 of Law Number 1 of 2023 concerning the Criminal Code for victims of violent theft; second, legal justice provided by the state through Article 34 of Law Number 1 of 2023 concerning the Criminal Code for victims of violent theft.
