Abstract

Abortion, which is often known as the act of aborting the pregnancy, is basically an act that is prohibited in Indonesia. In the Criminal Code, abortion is included in the chapter on crimes against life. Abortion is still debated by pro-life and pro-choice groups. The increasing maternal mortality rate, the International Conference on Population and Development in Cairo, 1994 and the Fourth World Conference on Women in Beijing, 1995 sought to safeguard women's reproductive health, as well as reduce the practice of illegal abortions performed unsafely and not performed by medical professionals. The reason that then led to the exception of the prohibition of abortion, namely in Article 75 paragraph (2) of Law No. 36 of 2009 on Health, stating that abortion may be performed on the grounds of medical emergency indications and pregnancy due to rape.However, in terms of medical emergency indications, the 2009 Health Act does not provide an explanation of the limits of medical emergencies clearly.
