TINJAUAN 'URF TERHADAP BUDAYA CAROK DI BANGKALAN MADURA

Lineage issues in legal studies in Indonesia have recently become interesting and important to pay attention to, especially regarding the carok tradition from the perspective of Islamic law. Carok is a unique event and it is difficult to get rid of the habits of the Madurese people. The ongoing phenomenon of fights that occur with fellow Madurese people often occurs in solving problems using physical squabbles and sharp weapons.
This study aims to determine the background and review the carok culture in Madura from the perspective of Ushul Fiqh. To achieve the research purpose using the theory of Usul Fiqh namely Al-'Urf. This research is qualitative research using a case study approach through interviews with the indigenous people of Madura.
Based on this study's results, carok is an activity considered anarchist and difficult for the Madurese people to eliminate. In the view of the Madurese people, anything that concerns their self esteem is one of the main causes of carok. likewise, the opinion of people outside madura that the existence of this tradition creares a stigma for the community. Madura has a tough character. Aspects of the carok problem that are against Islamic law are called ‘Urf Fasid and those that are in accordance with Islam are called ‘Urf Sahih. Carok traditions which include ‘Urf Fasis include ‘Urf Fasid include inheritance disputes, defeat in village head elections, and their identity being denigrated. Besed on its purpose, this habit is included in ‘urf fasid because there are things tht are contrary to Islamic law. However, there are stages of implementation that can be categorized as ‘urf sahih because they do not conflict with Islamic law.
