Abstract

The Indonesian nation in dealing with corruption is often unable to eradicate it from its roots. So in many cases of criminal acts of corruption committed by perpetrators to enrich themselves, the confiscation process carried out by prosecutors is often less than optimal so that the recovery of losses to the state cannot be paid. Optimizing investigations carried out by prosecutors will minimize returns to state losses. This paper has a problem formulation regarding the mechanism for confiscating assets by prosecutors in cases of criminal acts of corruption in the investigation and management stages of confiscated assets in cases of criminal acts of corruption. The aim of this research was to find out how prosecutors optimize asset confiscation at the investigation stage, so that assets resulting from criminal acts of corruption can be used as compensation for state losses. This research uses an empirical juridical approach. By using two types of data sources, namely: primary data and secondary data, as well as using interview techniques and literature study. Data will be analyzed using qualitative analysis techniques. The suggestions that the author can give regarding this research are suggestions related to more efforts to optimize the confiscation of assets at the investigation stage, management efforts carried out by the prosecutor's office, and efforts to recover state losses.
